Family Law

 

We provide legal solutions to clients’ diverse family law related challenges. This would include:

 

• Advising on and drawing up Ante Nuptial Contracts
• Representing client in divorce matters
• Resolving children maintenance and custody issues, among others
• Providing cutting edge solutions to customary law marriage related issues
• Drafting the requisite settlement agreement where parties have reached agreement regarding their divorce.
• Liaise and engage with the family advocate and social workers where necessary.

Wills, Estates, Inheritance, Trust Law

 

Inheritance and asset related matters will invariably be accompanied by disputes and feuds among family members, etc. This is where we come in and hold the family members by the hand(s) and advise them on how to navigate the challenges of the moment, every step of the way. In this regard, we also do the following:

 

• Drafting will(s) for clients according to each client’s circumstances.
• Assist with reporting an estate to the Master of the High Court where death has occurred.
• Provide comprehensive advise regarding the difference between testate and intestate succession.

 

Where immovable property is involved, we oversee the transfer and registration process thereof to the rightful beneficiary.

 

Assist with the administration of the estate all the way until the drawing up of the Liquidation and Distribution Account, which we subsequently lodge with the Master of the High Court.

 

Litigation 

 

We litigate on behalf of clients in a broad spectrum of practice areas; for example:  contractual debt disputes; insurance contractual disputes; procurement law disputes, etc.

 

We also litigate where personal rights are infringed. We act for both Plaintiffs and Defendants.

 

Commercial Drafting

 

We consult on, advise, structure and draw up various commercial contracts according to client’s requirements.

 

Corporate Governance and Compliance

 

The firm has drawn up copious Corporate Governance and compliance related documents and policies. To mention a few:

Stokvel Law

 

Our firm has drawn up Stokvel Founding documents for various stokvel groups. Stokvel Founding document are:

 

• Minutes of meeting to set up stokvel.
• Requisite resolutions by the founding members.
• Stokvel Founding Document/Constitution and the adoption thereof.

 

These are drawn up in line with the requirements set out by the banks for the stokvels to be able to open a banking account.

 

Credit Law/Consumer Law

 

We have provided legal opinions to Financial Services Providers in matters relating to the National Credit Act, e.g. “who is a credit provider”?  We assist clients, without fail, who believe they are unfairly placed on debt review.

 

Pension and Provident Funds Law

 

Invariably, where there has been a distribution of death benefits of a deceased Pension/Provident Fund member, someone will Cry Foul. We assist in these situations and we then utilize the opportunity to educate.

 

Canon Law

 

We are well versed in Canon Law Litigation. We have given several Legal Opinions on Canon Law related disputes. We have successfully defended the clergy in their various church governance related matters.
