MNA is situated in Midrand, Gauteng within close proximity of the courts, bargaining councils and Commission for Conciliation for Mediation and Arbitration. Notwithstanding its positioning, MNA has litigated and provided its services throughout the country. We can assist clients in English.

Background
MNA was established by Miroshni Naidoo in May 1997. Due to the ever increasing workload and skill set as a result of the growing staff complement, our team now comprises of one full time attorney and assistant staff.

MNA is alive to our Client’s concerns regarding legal costs which are generally only partially recoverable if at all. We are thus amenable to negotiating fees on commencement of instructions. We also maintain transparency throughout proceedings and provide our Clients with regular updates on fees and costs.

Strategy
MNA divides its legal services into employment, Criminal and general civil law with individual staff dedicated to specific services within the respective divisions. Hence our expertise covers but is not limited to commercial litigation, administration of deceased estates, Conveyancing and property law in addition to employment and criminal services.

Individual staff are assigned to teams to attend to matters which encourages team work, ventilates different counsel in view of the most beneficial recourse and ensures that multiple staff are capable of informing the Client of current developments or engaging opposition.

AREAS OF EXPERTISE

Criminal Law
MNA has extensive experience in criminal investigation, prosecution and defence. MNA further advise Clients of their obligations in respect of reporting potential criminal conduct.

The defence of Clients entail investigation parallel to the State to reveal exonerating and or mitigating factors as well as appearance at bail hearings through to trial and thereafter.

Debt Reviews
MNA has extensive experience in Debt review matters and attend to move applications on behalf of the Debt Counsellors.

In addition to the above we also act as correspondent attorneys for Absa and First National Bank.

General Civil Law

Wills, Estates and Conveyancing
MNA prepare Last Wills and Testaments, administer deceased estates and attend to conveyancing of deeds of immovable property. This section aims to provide an expeditious service to Clients with regular updates on progress and conclusion. Miroshni Naidoo has been a conveyancer since September 2005. She attends to all types of transfers including opening of sectional title registers. We attend to transfers in all Deed’s Offices throughout the country.

Contracts
Contract law forms the basis of nearly all commercial interactions and although many people do not realize it, they enter into several contracts each day. Contracts include the obvious examples, such as lease agreements, employment contracts, and purchase and sale agreements.

Commercial Litigation
Commercial litigation is a business-related risk and ought to be approached as such with the aim of limiting the period of proceedings, legal cost and exposure to the Client. MNA advise Clients on various Commercial aspects including, Suretyship Agreements, Lease and Credit Agreements and breaches of contract. 

 

Legal Fees
MNA focuses on the needs of the Client and as such, it is amenable to reasonable negotiation of its standard fees based on the complexity of the matter, anticipated length of proceedings, financial wherewithal of the Client and public interest in the dispute to name a few considerations.

MNA considers representing clients on a contingency fee basis on occasion where the merits of the dispute warrant and in light of the financial circumstances of the Client.

The rate for an attorney is dependent on the attorney handling the matter and complexity of the dispute.

Capacity
MNA has the capacity, due to its staff complement, to litigate in multiple forums at the same time and this often occurs.

In the event that a staff member is not available to represent a client, alternatively, is limited in his or her ability to prepare due to time constraints, adequate and reasonable contingencies will be communicated to the Client. These contingencies may include postponement of the matter, instruction of an Advocate and or referring the Client to another competent attorney.

Pro Bono
MNA assists Clients on a pro bono basis on occasion where the consequences of the dispute demand that the Client is represented in order to fully exercise their legal rights where the Client would not be able to afford legal representation.
