General Past Experience
Magistrates court a civil procedures in both defended and undefended matters, including the collection of large debt, drafting and issuing of summons’s and all further pleading’s and notices, drafting affidavits including Discovery affidavits, preparing for trial, consulting with witnesses, running civil trials, drawing bills of cost and attending to taxation thereof, Motion court appearances, obtaining excellent knowledge of rules of court, drafting opinions and giving advice to clients.
I have for twenty five years run a full magistrates court and high court litigation practice which includes, but is not limited to, commercial, insurance short term and life, banking and general litigation, from commencement to finalisation of the trial. I have conducted criminal trials, with excellent practical experience in criminal procedure, including interfering witnesses and taking statements, attending at court, making bale arrangements and urgent bale applications.
High court civil procedure: including attending trials with council and assisting council generally, consulting with witnesses and clients, attending consultations with witnesses and clients before council drafting opinions related to the practice of the high court, obtaining an excellent working knowledge of the rules of court, drafting pleadings, various notices and affidavits, including Discovery affidavits, drawing bill of cost and attending to taxation thereof, attending pre-trial conferences and attending to the preparation of trial, indexing and paginating. My experience includes taking instructions for high court applications, drafting the applications, drafting affidavits, attending to instruct council where necessary, alternatively appearing personally. I have vast experience in all applications including liquidations and sequestrations, interdict, Rule 43, and urgent applications of all nature.
Commercial work including inter alia agreement of sale of business and closed corporations, partnerships agreements, franchise agreements, cc members agreements, incorporating companies and opening and opinion work, administration of deceased estates and trusts, furnishing legal opinion and advice, interpretation of various statutes, labour law and employment-related matters. I have written a manual and run a course for a private training institution on disciplinary enquiries, training the chairperson in disciplinary hearings, and training the prosecutors, the evidence etc. A copy of the manual is available upon request.
General legal work including family law, ANC and ANC with accrual contract, collections of debt, contracts of any nature, banking insurance and financial work experience.
For two years I was the national legal advisor at Comcorp Pty Limited, which is a financial services company. I set up the entire legal department in 1997 from non-existent and I supervised the legal department. I had approximately ten members of staff reporting to me in the corporation. My functions included, strategic planning of legal matters, attending to and running defended and undefended litigation matters, the recovery process, credit decisions, risk management, structuring deals, monitoring changes in the law and advising management, drafting and negotiating commercial contracts on behalf of directors, attending board meetings and reporting to shareholders, weekly detailed reports on bad debts, recovery processes and success and risk analysis, instructing company attorneys and monitoring the handing over of high court litigation.
During 1998 I completed the Jenny Weinstein conveyancing course. Started my own full conveyancing department for twenty five years while I was practicing on my own account.
