Notable matters
- Successfully settled a claim representing a day-care school (and later its commercial insurer – an Insurance Company listed on the JSE), in trial proceedings for damages instituted by parents of students at the school, based on allegations of abuse by teachers, founded in delict and breach of contract.
- Advised a property developer in a construction arbitration with contractors regarding a commercial development in Gqeberha.
- Part of the team that represented an international tyre manufacturer in an investigation by the Competition Commission into price fixing in the tyre industry.
- Part of the investigation team that investigated liquidity problems and the ultimate failure of VBS Mutual Bank, instructed by the Prudential Authority of the South African Reserve Bank, eventually uncovering a fraud estimated to be around R2-billion.
- Part of the team defending a Multinational Engineering firm in arbitration proceedings against a claim (with a quantum of R350-million) relating to the stability of a toxic waste facility constructed for mining waste.
- Part of the team that represented an investment company listed on the JSE in arbitration proceedings pertaining to financing transactions (debt and equity financing) extended to the National Lottery Operator of R325-million.
- Advised an agricultural enterprise and financier on several high value agricultural loan disputes, acting for the financier and seeking to recover outstanding debts and recover assets in liquidation proceedings.
- Advised, together with a director of Werksmans, a major international technology manufacturing company on its South African operation’s internal audit function and their compliance with current and impending legislative provisions regarding corruption and its duty to report (and duty to implement safeguards to detect) corrupt activities.
- Part of the team that represented PRASA in court proceedings to review and set aside an irregular tender contract concluded with Swifambo Rail Leasing with a total contract value of R3,5-billion.
- Part of the team that represented the PRASA in court proceedings to review and set aside an irregular tender contract concluded with Siyangena Technologies with a contract value of approximately R5,5-billion.
