Description:

Brian Kahn Inc. strives to deliver superior legal advice and solutions with integrity, innovativeness and initiative.

Umlilo – an African word which means fire.

Simply; we recognise the need to add value to a client’s business, to participate wherever possible in achieving a client’s expectations, objectives and vision. We have the infrastructure, commitment and passion to do so, but can only do so to the optimum where permitted by our client so to do. This involves, inter alia, an appreciation by clients as to what is their role in the process and how they need to establish a working relationship with their legal advisors, and vice versa. It also involves an understanding of, inter alia, strengths, weaknesses, cultures, visions, needs, hopes, ideas and on occasion, a client’s dreams.

Service

Commercial Law

Passion for commercial law, business transactions and corporate activities drives our Commercial team. We advise and guide clients. We negotiate and draft agreements. We develop structures. We create solutions.

Our expertise covers mergers and acquisitions, BEE transactions, joint-ventures, takeovers, disposals, competition issues, corporate governance, restructuring, due diligence, exchange control matters and corporate recoveries.

We apply a rigorous negotiating process, but we are deal-makers, not deal-breakers. We add value by drawing attention to options and alternatives. Our input has helped close deals worth hundreds of millions, yet the same professionalism characterises our approach to much smaller transactions.

Whatever the nature and scope of the brief, our commercial team means business.

Litigation & Dispute Resolution Law

Reaching the optimum outcome is the result of core competence in our Litigation & Dispute Resolution Department. The team focuses on corporate commercial litigation, arbitration, alternative dispute resolution ... and you, our client.

Every dispute is unique, requiring individual treatment and creative solutions. We seek win-win settlements through dispute resolution, but when litigation is unavoidable, we pursue our client’s interest with single-minded rigour.

We advise across a comprehensive range of issues, including insolvency and liquidations, engineering and construction disputes, contractual disputes, property, advertising, defamation, due diligence, corporate fraud and financial, banking and competition law.

Clients look to Litigation & Dispute Resolution when looking for results.

It is an unfortunate reality that most organisations become involved in disputes at some stage. Resolving disputes can often be stressful, disruptive and costly. As commercial organisations explore new markets, new technologies and new ways of doing business, the importance of effective dispute management has never been greater.

Our role is not limited to fighting fires. We believe that many disputes are predictable and therefore avoidable. Sometimes disputes cannot be foreseen or avoided, but they can be effectively managed. Sometimes an aggressive litigation strategy is called for. Often, negotiation or mediation is more appropriate. Whatever the dispute, we always aim to find commercially realistic and cost effective solutions.

Employment Law / Labour Law

Labour law is one of the largest areas of legislative growth. Clients require a broad range of legal and advisory skills. Our team provides the professional one-stop solution to this non-stop labour law challenge.

We draft agreements, contracts, codes, policies and industry guidelines and help with process implementation. We provide advice and assist with collective bargaining; consult with unions over organisational rights and develop solutions to resolve disputes. Advice and support are provided with retrenchments, restructuring and outsourcing. Advice on statutory provisions and representation at various forums are all part of the service.

In the labour field, we’ve got all the tools to get the job done.

In 1997, BKI developed its own office building which it named “Umlilo House”. The source of and inspiration for the name (which means “fire” in Zulu), emerges from the vision and culture of the firm which is dynamic, progressive and effective in achieving success for its clients.
